Thanks to court order, HIV positive bus driver back at the wheel

A year after a HIV-positive bus-driver was sacked by the Maharashtra State Road Transport Corporation, the Bombay High Court has given him his job back. Reacting to the verdict, 43-year-old Ramesh Bhamre (name changed) said, "I am happy that I can get my job back now. I wish others don't have to go through the trauma that I did to get my basic rights."

> Ramesh Bhamre was sacked by the MSRTC in May 2012 on the grounds that he was "unfit to work". Bhamre, who had been working as a driver since 1999, had told the MSRTC that owing to the treatment he was receiving, he was physically weak. He had requested "light work" rather than being asked to drive heavy vehicles. Stating that there was no legal provision for changing the job profile of HIV-positive employees, the transport authority had removed him from service. But, Bhamre decided to fight the stigma, accusing the MSRTC of discriminating against him because of he was HIV-positive.

> Declaring that every citizen had the right to work and could not be discriminated against, a Bombay High Court Bench consisting of Justice Abhay Oak and Revati Mohite-Dhere stated that Bhamre should be reinstated within a week. The Bench also ruled that the State Transport Authority was liable to provide him compensation for the year he spent out of work.

> As he stood in front of journalists on Thursday afternoon, Bhamre was initially at a loss for words. He discovered he was HIV-positive in 2008 and it had been, he said, one long struggle since. Dealing with the stigma had, he said, worn him out. His teenage son was forced to take up work in a factory to make ends meet, he said. "My wife and two sons struggled as I watched helplessly," he said.

Bhamre's case was fought on the basic premise of the rights given by the Constitution, Mr. Sarode stated. "The constitution provides us with the right to work, to live and the right against discrimination on any grounds. It was this simple argument that the High Court accepted," he said.

> The MSRTC, which has denied having discriminated against Bhamre, has maintained that there was "a lack of policy" defining employment options for HIV-positive patients. "We were waiting for directives from the State government. [With the High Court having given its verdict], we can give him alternative responsibilities," an MSRCTC spokesperson stated.

> The High Court will decide on the amount of compensation to be provided to him at a hearing next week.

Putin calls Kerry a ‘liar’

Russia's President Vladimir Putin upped the ante on Syria accusing Washington of "lying" about the likely fallout of a U.S. attack on the Middle East nation.

> Mr. Putin said US Secretary of State John Kerry "lied" at Senate hearings on Tuesday by claiming that a military strike against Syrian President Bashar al-Assad would not strengthen al-Qaeda in the region.

> "They lie, plainly. I watched the Congressional debate. A congressman asked Mr. Kerry: 'Is there any al-Qaeda [in Syria]? There are reports they may grow stronger.' He [Kerry] replied: 'No. I say with all responsibility: they are not there'," Mr. Putin said at a meeting with the Kremlin Council on Human Rights on Wednesday.

> The Russian President stressed that al-Qaeda had been at the forefront of the rebel groups fighting the government forces in Syria, and that the U.S. was well aware of that.

EPFO to start online facility to view updated ACs

Retirement fund manager Employees' Provident Fund Organisation (EPFO) will launch an online facility on Friday where over 5 crore subscribers can view their updated accounts.

"We will launch the facility tomorrow where subscribers can track their accounts online on a real-time basis and check their updated accounts," EPFO's Central Provident Fund Commissioner K.K. Jalan told PTI.

At present, subscribers get account statements once a year. The Employees' Provident Fund Organisation (EPFO) has to dispatch annual PF account slips by September. The PF slips for 2012-13 are supposed to be provided by September 30, 2013.

Sometimes, it takes longer to receive the statements because the EPFO hands them over to employers for distribution to workers.

The new facility will enable subscribers to see their updated accounts and take printouts for their records.

Mr. Jalan said EPFO members would be able to see their account balances, including credited interest, as of March 31.

For the period starting in April, they would be able to see the amounts credited to their accounts every month without the interest component because the rate of return on PF deposits for this fiscal has not been announced, he added.

Mr. Jalan also said the EPFO will issue annual PF account slips on demand.

The facility will be launched by Labour Minister Sis Ram Ola on Friday at the EPFO headquarters in the capital.

All members, including those with inoperative accounts, will benefit from online access, Mr. Jalan said. The EPFO makes accounts inoperative when a contribution is not made for 36 months in a row.
